Terms of Service

Welcome to Nail Police. These terms establish the guidelines and rules for using our platform. By accessing our services, you're agreeing to these terms and related policies.

This agreement represents a binding contract between Nail Police and you (referred to as the 'Customer'), whether you're paying for or receiving our services.

Overview

Nail Police provides an automated nail-biting detection and behavior modification service. We use advanced computer vision technology and machine learning to detect when you're biting your nails in real-time. Our desktop application runs locally on your computer, monitoring your behavior and providing immediate feedback to help you break the nail-biting habit. All detection processing happens on your device to ensure complete privacy.

Eligibility

To use Nail Police, you need to be at least 18 years old. By proceeding, you confirm that:

  • You've reached the age of 18 or above.
  • Your account is in good standing with no previous suspensions.
  • You're following all relevant laws and regulations.
  • When representing an organization, you have proper authorization to act on their behalf.

Account Access

Access to our platform requires creating an account via email authentication or Google Sign-In. This connection allows us to securely manage your subscription and provide you with our services across devices.

Payment Guidelines

Our service requires a subscription after the free trial period. All fees are in USD and processed through Stripe. Subscription fees are generally non-refundable except as outlined in our Refund Policy or where required by law. We maintain the right to adjust our pricing with 30 days notice.

Licensing Terms

  • Usage License: You receive a personal, non-transferable license to use our software for personal, non-commercial purposes on devices you own or control.
  • Your Data: All camera images remain on your device. We do not store, transmit, or have access to your camera feed or detection footage.
  • Usage Restrictions: Our service cannot be reproduced, modified, reverse-engineered, or distributed without explicit written permission.

Intellectual Property

Nail Police retains ownership of all software, algorithms, design elements, and service components. Our platform and technology are protected by intellectual property laws. The Nail Police name, logo, and branding are our exclusive trademarks.

Third-Party Services

Our platform integrates with third-party services including Firebase (authentication and data storage), Stripe (payment processing), and Google (optional authentication). While we're not responsible for their content or services, we recommend reviewing their terms before sharing information.

Privacy and Data

Camera Access: Our application requires camera access to function. All camera processing happens locally on your device. We do not upload, store, or transmit your camera feed to any server.

Analytics Data: We collect anonymous usage statistics (detection counts, session duration) to help you track your progress. This data is associated with your account but does not include any camera footage or images.

Your Rights: You maintain complete control over your data and can request deletion at any time by contacting support.

Communication

We'll keep you informed about our services, important updates, and your subscription status via email. You can opt out of promotional messages through the unsubscribe option, but you may continue to receive essential service-related communications.

Prohibited Activities

Our platform must not be used for:

  • Illegal purposes or activities that violate any laws or regulations
  • Monitoring or surveilling others without their explicit consent
  • Attempting to circumvent payment systems or subscription requirements
  • Reverse engineering, decompiling, or disassembling our software
  • Interfering with the service's operation or other users' access
  • Distributing malware or harmful code through our platform

Terms Updates

These terms may be updated periodically to reflect changes in our service or legal requirements. Significant changes take effect 30 days after posting on our website, and continued use indicates acceptance. We'll notify you via email of material changes.

Service Duration

  • Duration: These terms are active from acceptance until termination by either party.
  • Account Closure: We may suspend or terminate access if terms are violated. You can close your account at any time by contacting support@nailpolice.com
  • Post-Termination: Service access ends upon termination, though you may continue to use the service through the end of your current billing period.

User Indemnification

You agree to protect, defend, and hold harmless Nail Police and its affiliates from any claims, damages, losses, or expenses (including legal fees) resulting from your use of the platform, violation of these terms, or infringement of any third-party rights.

Service Disclaimer

Our service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or completely secure. Nail Police is a behavior modification tool and should not be considered medical advice or treatment. Usage is at your own discretion and risk.

Liability Limit

To the maximum extent permitted by law, Nail Police shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our maximum liability is limited to the amount you paid for the service in the 12 months preceding the claim, or $100 USD, whichever is greater.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Nail Police operates, without regard to its conflict of law provisions.
